Former Toronto Blue Jay Roberto Alomar and his ex-girlfriend Ilya Dall have settled her explosive lawsuit in which she claimed Alomar made her have unprotected sex even though he had AIDS. Dall sued Alomar in federal court in February for $15 million (U.S.).
An order from a judge yesterday said a settlement had been reached. Alomar’s lawyer, Charles Bach, said Dall voluntarily withdrew the suit, but wouldn’t say if his client paid Dall. Dall’s lawyer had no comment.
Dall claims she is suffering from “AIDS-phobia,” and her mental distress is “continuing, severe and permanent.” She believes “AIDS-phobia” is akin to Post Traumatic Stress Disorder (PTSD).
She accused Alomar of “gross negligence” by exposing her children to the disease because he kissed them, got saliva on them, and put his toothbrush next to theirs. The HIV virus can not be transmitted through saliva.
Among Dall’s more explosive allegations is that Alomar told her he’d been raped by two men while playing baseball in the southwestern United States when he was 17 years old.

Alomar, 41, denied the allegations in the suit when it surfaced and has said he is “in very good health.”
The suit alleged Alomar was told repeatedly by doctors to get tested for HIV and finally did so in January 2006. The following month, the suit said, a specialist discovered the former star of the Blue Jays’ World Series titles had a mass in his chest.
The suit says on Feb. 21, 2006, Dall observed the following symptoms in Alomar: “Purple skin, too sick and weak to walk … foaming at the mouth, couldn’t swallow. ” She went on to say “a spinal tap proved (Alomar) was indeed suffering with full-blown AIDS.”
NBC Washington claims the lawsuit doesn’t even allege Alomar had knowledge.
“The language in each of their statements is very careful to slam the merits of the case and not the assertion that Alomar tested positive for HIV. There’s a big difference, because the only issue is if Alomar knowingly engaged in unprotected sex once he knew his HIV status. The suit itself says that he didn’t, which makes the whole thing seem like nothing more than a cruel cash grab by Alomar’s ex-girlfriend.”
Alomar said in his statement defending the allegations: “As for the lawsuit, it is filled with lies and I am deeply saddened that someone I cared for would make such terrible accusations and try to hurt me in this way.”
Alomar’s current girlfriend, Maripily Rivera (aka the Paris Hilton of Puerto Rico) says claims by Ilya that Alomar has AIDS is a “vile lie.” Rivera has now issued the following statement to press:
“When you’re on the side of truth, you have nothing to hide,” said Rivera. “I support him and I love him more than ever.”
“It’s not true. It’s a very delicate case. He feels comfortable because when you’re telling the truth, you don’t have anything to hide … He’s never gotten sick with me. We train together and he has well-defined and beautiful arms.”
“Now that it’s all over we’re more united than ever,” Rivera told Puerto Rican newspaper Primera Hora yesterday. “I always was confident in him and knew he told the truth.”
